Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees who were exposed
to struck by hazards.
At the site:  Employer did not furnish a place of employment free from
struck by hazards when
power equipment was being operated on a public road against the
manufacturer's
recommendations.  As a result, the operator was struck by a motorist and
seriously injured.
Feasible abatement methods include, but are not limited to, the following:
1.  Find a safe alternate route that precludes travel over public roads.
2.  Use an escort that is approved in accordance with the Massachusetts
and Federal Department
of Transportation regulations to escort the machinery when the machinery
is
on a public street.
3.  Use a police escort in accordance with the Massachusetts and Federal
Department of
Transportation regulations when moving the machinery along public roads.
4.  Read, understand and follow all manufacturer's warnings and
instructions as to use and
transportation of the piece of equipment.tion
