Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards while operating a powered industrial truck in a manner that was not in accordance with the manufacturer's instructions. The employer does not ensure that each powered industrial truck operator and employees working adjacent to the powered industrial truck is protected from struck-by hazards in the event of a boom collapse or structural steel collapse caused by operating the forklift in a manner not intended by the manufacturer. This violation occurred on or about December 4, 2007 at a worksite located at Building A, 220 O'Connell Way, Taunton, MA. To abate this violation, the employer must ensure that all powered industrial truck operators follow the operating instructions, warnings, or precautions listed in the operator's manual for the types of vehicles that the employees are operating.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards while operating a powered industrial truck on uneven ground and not wearing the seatbelt provided by the manufacturers. Building A: On or about December 4, 2007 employees were not protected from the hazard of being crushed while operating the powered industrial truck without a seatbelt. Among other methods, one feasible and acceptable means of abatement would be to utilize the operator restraint devices that are provided by the powered industrial truck manufacturer.
