Section  5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not furnish employment and a place of employment which is free
from recognized hazards that were causing of likely to cause death or
serious
physical harm to employees in that employees were exposed to fall hazard
from trailers:
a.  Jobsite: Twin Oaks Terminal, Aston, PA- On or about February 26, 2007
an employee (driver) was repeatedly exposed to a fall hazard when engaged
in
the task of loading vehicles on trailer (486253) and walking on a platform
or/and descending a fixed ladder.  The driver was walking the trailer's
deck
(platform) that did not have standard railings and descending a fixed
ladder
that did not have side rails that extended above the top deck.
b. Jobsite: Twin Oaks Terminal, Aston, PA- On or about March 16, 2007 an
employee (driver) was repeatedly exposed to a fall hazard above 8.5 feet
while
engaged in the task of loading vehicles on trailer (469610) and walking
down a sleet-
covered deck (platform) that did not have standard railings.
c. Jobsite: Twin Oaks Terminal, Aston, PA- On or about March 16, 2007 and
employee (driver) was repeatedly exposed to a fall hazard above 8.5 feet
while
engaged in the task of loading vehicles on a trailer while walking down on
a sleet-
covered platform that did not have standard railings.
d.  Jobsite: Twin Oaks Terminal, Aston, PA- On or about March 16, 2007 and
employee (driver) was repeatedly exposed to a fall hazard above 8.5 feet
while
engaged in the task of loading vehicles on a trailer (469442) while
walking down on a
sleet-covered platform that did not have standard railings.
ABATEMENT NOTE: Among other means of abatement, one feasible and
acceptable means
of abatement would be to implement one of more of the following processes:
(1) Eliminate the fall hazard of loading, securing vehicles and descending
from the
decks by using trailer that allows vehicles to be loaded and secured from
ground
level.
(2) Install guardrails on the trailer's deck as well install side rails on
the fixed ladders
which extend above the top deck.
