Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a. Jobsite-Twin Oaks Terminal, Aston, PA- Truck driver who were engaged in the task of loading vehicles to the truck's trailer were repeatedly exposed to fall hazards while driving each vehicle on the trailer and descending from the vehicle to ground level. The drivers walked on the edge of the trailer at 8.5 feet above ground level without any means of fall protection and descended a fixed ladder that did not have side rails extended above the top deck. This was observed on or about 2/26/07. b. Jobsite-Twin Oaks Terminal, Aston, PA- A truck driver who was engaged in the task of loading vehicles to the truck's (61110) trailer was repeatedly exposed to fall hazards while driving each vehicle on the trailer and descending from the vehicle to ground level. The driver walked on the edge of the trailer at 8.5 feet above ground level without any means of fall protection and descended a fixed ladder that did not have side rails extended above the top deck. This was observed on or about 3/6/07. c. Jobsite-Twin Oaks Terminal, Aston, PA- A truck driver who was engaged in the task of loading vehicles to the truck's (4375) trailer was repeatedly exposed to fall hazards while driving each vehicle on the trailer and descending from the vehicle to the ground. The driver walked on the edge of the trailer at 8.5 feet above ground level without any means of fall protection and descended a fixed ladder that did not have side rails extended above the top deck. This was observed on or about 3/6/07. Allied Systems was previously cited for a violation of Section 5 (a) (1) of the Occupational Safety and Health Act related to fall hazard from a fixed ladder, which was contained in OSHA inspection number 308435809, citation number 1, item 1a, issued on July 10, 2006, with respect to a workplace located at Jacksonville, Florida. ABATEMENT NOTE: Among other means of abatement, one feasible and acceptable means of abatement would be to implement one or more of the following processes: (1) Eliminate the fall hazard of loading, securing vehicles and descending decks by loading the vehicles on trailers where vehicles can be loaded at near ground level. (2) Equip trailers with platforms with guardrails as well as access to fixed ladders with side rails extending above the top deck. NOTE: ABATEMENT CERTIFICATION REQUIRED.
