Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to an injury from not being restrained in a forklift in case of tipping and/or roll over: a)Maintenance Shop: The seatbelt on the Caterpillar Forklift, model: V35D, serial: 5HB3439, was inoperable. The forklift was equipped with seatbelts, however the employees could not use the restraint device. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THE HAZARD IS TO WEAR THE SEATBELT AS REFERENCED IN ITSDF B56.1-2005, "SAFETY STANDARD FOR LOW LIFT AND HIGH LIFT TRUCKS."
