NYSLL Article 2 Section 27-a(3)(a)(1): The employer did not furnish to each of its employees, employment, and a place of employment which is free from recognized hazards that are causing or are likely to cause death or serious physical harm to its employees and which will provide reasonable and adequate protection to the lives, safety, or health of its employees: (a) NYC TA - Employees of the Division of Rolling Stock and Maintenance of Way (MOW) were exposed to the hazard of being struck by a revenue train while carrying equipment over live tracks. A feasible and useful abatement method for reducing the hazard, among others, is: (1)Flagging Protection performed by adequate personnel qualified by experience and traning to perform effective flagging.
