Section 5 (a) (1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: On or about january 8, 2007, at the project zone, the employer did not ensure that employees working inside the danger zone during tree felling operations were properly spaced to protect them from the hazard of being struck by a falling tree or flying wood fragments. Among the feasible methods of abating this hazard are to assure compliance with the Company's policy for removal of tree, which requires employees to stay out of the danger zone during tree removals.
