Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to broken bones, concussions, lacerations and death from falling: On 3/14/07,an employee servicing a roof top HVAC units was required to use a fixed industrial laddes to access the roof. Employees are also required to carry tools and equipment on the roof to service the roof creating a fall hazard. Specifically, on 3/14/07, an employee carrying a nitrogen tank fell from the ladder. Among other methods, one feasible means of abatement would be to use ropes to carry equipment to the rooftop. Another feasible means of abatement would be to use a pouch holster to carry tools and equipment.
