Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY: a)On or about 8/22/07, Exterior of the building, East Side: The employer failed to ensure that aerial lifts were inspected and function tested prior to the start of the work shift, failed to ensure that self closing hinges were operational, failed to ensure that the lift doors were closed prior to employee use, and failed to provide operator training. Among other methods of abatement, one feasible and acceptable means of abatement is to follow the Operators & Safety Manual provided by JLG Industries, Inc. Including, but not limited to sections 1.2, 1.3, 2.1, and 2.2.
