Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to THE HAZARD OF BEING STRUCK-BY:
a)Vincent Manufacturing Co., Inc., on or about 01/04/08.  The employer
failed
to have a passenger carrying freight elevator inspected, tested and
maintained
in accordance with NYSDOL Industrial Code 8 - Construction, Guarding,
Equipment, Maintenance and Operation of Elevators, Dumbwaiters,
Escalators, Hoists and Hoistways in Factories and Mercantile
Establishments.
b)Vincent Manufacturing Co., Inc., on or about 1/04/08:  Passenger carrying
freight elevator had the following deficiencies:
(1)The car gate was missing from the front;
(2)Interlocks and electrical circuits had been overridden which allowed
the car to operate with the hoistway doors open;
(3)Car light circuit was non-functioning;
(4)Stop balls missing on all floors.
Abatement certificaton must be submitted for this item.
Among other methods, one feasible and acceptable abatement method to
correct
these hazards is to contract for an authorized agent to perform periodic
inspections
of the freight elevator every six months in accordance with paragraph
8-1.7 of
NYSDOL Industrial Code 8. Install a front car gate and repair the existing
hoistway
door electrical system in accordance with paragraph 8-1.21 of NYSDOL
Industrial
Code 8.  Repair the car light circuit and replace the missing ball stops
on all floors
as required by paragraph 8-1.42(a)(1) and 8-1.32(e) of NYSDOL Industrial
