Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by and/or caught in between hazards: (a)Line 2, Side Rail Area: On April 18, 2007, and at times prior there to, employees were exposed to struck by and/or being caught between trailers when other employees manually moved trailers without having a clear view of the travel path to ensure that employees were all clear. Among other methods, feasible methods to abate this hazard would be to either use a spotter that will assure no one is in the path of the trailer as it is being pushed, use a crane with a waning alarm to pull the trailers backwards, and/or have the crane operator positioned so as to see that no one was in the path of the trailers or warned employees during the movement.
