North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards and struck by hazards: a)jobsite, Sky Trak 6036, while employees worked from and elevated platform, 16 feet from the ground, the rough terrain forklift truck was left unattended and the platform was not equipped with controls. Among other methods, one feasible and acceptable abatement method to correct this hazard is to ensure that a trained operator is in position to control the rough terrain forklift truck or available within 25 feet from the truck, which remains in his view.
