Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: Employees were exposed to a fall of approximately 15 feet while working at an elevated position on a powered industrial truck platform. The employer did not ensure that the platform was securely attached to the forks or lifting carriage of the Toyota truck; that the platform was equipped with rails or other restraining means; or that employees used appropriate fall protection. Abatement note: Feasible abatement may include following the precepts of ASME B-56.1, Safety Standard for Low Lift and High Lift Trucks, 2005 edition, which requires that platforms be secured to the forks of the lift truck, that fall protection systems be used, and that platforms be equipped with a guard rail system.
