Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm, including severe burns to employees in that employees were exposed to dust explosion, deflagration, or other fire hazards from mixers not being dust tight: In the grinder area, mixers were not maintained to ensure a dust tight seal when the doors to the mixers were not sealed and opening(s) such as pressure relief valves were left open. During mixing operations with combustible dust, dust would leak out into the air posing combustible dust hazards. Among other methods, a feasible abatement method to correct this hazard is to comply with NFPA 61 Standard for the Prevention of Fires and Dust Explosions in Agricultural and Food Processing Facilities, 2008 edition, section 10.3.1: "A method shall be used to prevent the escape of dust from the process equipment into the surrounding environment." including, but not limited to: a) Repair seals on the mixers. b) Tightly close and latch mixer doors. c) Close all openings on the mixers where dust could leak.

Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm in that employees were exposed to the hazard of fire and explosion from dust collectors for combustible dust being located inside buildings: (a) The animal feed dust collection unit was located inside the Powder Room; (b) The powder return systems were located inside the Powder Room. Among other methods, feasible abatement methods to correct this hazard are to comply with NFPA 61: Standard for the Prevention of Fires and Dust Explosions in Agricultural and Food Processing Facilities, 2008 edition, section 10.4.3: "Location. Dust collectors shall be located outside of buildings and shall be protected in accordance with Section 6.3." including, but not limited to: a) Relocate dust collectors outside of the building. b) Equip each dust collector with a deflagration vent which is vented to the outside and which has been designed to withstand the effects of deflagration. c) Install a deflagration suppression system in accordance with NFPA 69.
