Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees were exposed to fall hazards while using the mobile ladder stand manufactured by The Equipment Company of America. Among other methods, one feasible and acceptable abatement method to correct this hazard is: Comply with the manufacturer's requirements and ANSI A14.7-1991 for Mobile Ladder Stands and Mobile Ladder Stand Platforms. Section 6.3(11) requires: "Units that are damaged or weakened from any cause shall not be used until repairs are completed. Units that are damaged, subsequent to their receipt, and/or are worn beyond repair shall be destroyed. Never climb a damaged ladder stand or ladder stand platform."
