Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Hazards associated with falls while climbing from the steel structure down to the guardrails of a scissor lift. Among other methods, one feasible and acceptable abatement method to correct these hazards is to comply with ANSI/SIA A92.6-1999 for Self-Propelled Elevating Work Platforms. Section 8.10(9) requires "Personnel footing. Personnel shall maintain firm footing on the platform floor while working thereon. Climbing by occupants on the midrail or toprail of the aerial platform is prohibited."
