Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that caused or were likely to cause death or serious physical harm in that the dust collectors, collecting combustible dust, did not adequately protect employees in the event of a fire and/or explosion. The NEP Turbo Plated (color) Process dust collector did not have a means to prevent the spread of internal fire or deflagration, up or downstream of the collector. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS is to comply with the National Fire Protection Association (NFPA) Chapter 61 "Prevention of Fires and Dust Explosion in Agriculture and Food Processing Facilities," 2008 edition; NFPA 69 "Standard on Explosion Prevention Systems" 2008 edition; NFPA 68 "Standard on Explosion Protection by Deflagration Venting," 2007 edition; NFPA 654 "Standard for the Prevention of Fire and Dust Explosion from the Manufacturing, Processing, and Handling of Combustible Particulate Solids," 2006 edition. Isolate dust collector fire and/or explosions by installing a material choke or a fast acting mechanical valve.
