Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards: On or about July 17, 2007, employees working in or near the tank farm at 201 S. Cedar Street, Valley Center, Kansas were exposed to fire and explosion hazards from Class 1B, 1C, and Class II and Class III flammable and combustible liquids. The pressure relieving and atmospheric vents on the tanks were not inspected to ensure their proper operation through regular testing and inspections. Among other methods, one feasible and acceptable method to correct this hazard is the perform periodic inspections of atmospheric and emergency vents for all the bulk storage tanks in accordance with American Petroleum Institute Standard 2000 (API Standard 2000) Venting Atmospheric and Low-Pressure Storage Tanks, Fifth Edition, April 1998. Paragraph 4.5.6 Maintenance, recommends inspections of tank vents as per API Bulletin 2521 and API Recommended Practice 576. 29 CFR 1903.19(c)(2) abatement of the above violation was verified at the time of inspection. No certification is required.tion
