Section 5(a)1 of the Occupational Safety and Health Act of 1970: The
employer did not furnish
employment and a place of employment which were free from recognized
hazards that were
causing or likely to cause death or serious physical harm to employees in
that employees were
exposed to struck-by and fall hazards:
On or about July 23, 2007, and continuing, at the facility, employees
working from an elevated
scissor lift at the workplace performing maintenance on overhead lighting
fixtures that was
located in the passageway of operational overhead crane were exposed to
struck-by and fall
hazards. Procedures had not been developed or implemented to protect
employee while working
from an elevated scissor lift such as but not limited to: placing warning
beacon on scissor lift,
locking or tagging out overhead crane, or coordinating maintenance
activities with production.
The overhead crane struck the elevated scissor lift causing exposing
employees to an
approximately 25 foot fall hazard.
AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO
CORRECT THIS HAZARD IS: Establish local ordinances, inform and train
employees on
the special precautions to be taken whenever working in the same area as
moving
equipment per ANSI standard 92.6-1990, section 8.10.2. "Warnings such as,
but not limited
to flags, roped off areas, flashing lights, and barricades shall be used."
29 CFR 1903.19(d)(1) requires certification and documentation that the
abatement of the
above violation is completed.
