Section 31-370(a) of the Connecticut Occupational Safety and Health Act:
The employer did
not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to a struck by hazard due to an employee in the
danger zone of a John
Deere loader carrying an unsecured load.

(1)On January 3, 2013 employees working on removal of a partially
fallen tree were not protected when a John Deere loader carrying
a length of a cut tree swung unexpectedly striking an employee
walking nearby. Among other methods, an acceptable means of
abatement would be to: 1. Cut tree into smaller sections more
easily handled 2. Secure load prior to the move 3. Create a
designated working radius around operating equipment
4. Inform employees of the job plan and possible hazards prior to
work commencement.
