Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by or crushing injuries: On or about March 26, 2007, employees are being exposed to being struck by the Caterpillar 930 Wheel Loader which was operated without an operational braking system. Among other methods, one feasible and acceptable abatement method to correct this hazard is to repair the brakes on the Caterpillar, Model 930, Wheel Loader in compliance with 1926.602(a)(4), which states in part that this type of equipment shall have a serviceable braking system capable of stopping and holding the equipment fully loaded, as specified by Society of Automotive Engineers SAE - J237, Loader Dozer - 1971. Maintenance of the brakes on the Caterpillar, Model 930, Wheel Loader, shall be performed in accordance with the manufacture's instructions and specifications.
