Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about November 2, 2007, an employee operating a forklift at DeHater, a Division of Sorce Enterprises, Inc. was exposed to crush-by hazards due to a fork truck tip over. The forklift the employee was operating had not been equipped with a seat belt/restraint retrofit from the manufacturer. Seat belt use was not required on other forklifts that had been equipped with seat belt/restraint retrofits from the manufacturer. Among the feasible means of abatement would be to comply with the American National Standards Institute B56.1-2004.
