Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards while working in the roadway. On November 15, 2007, the employer did not ensure that the employees who were working in the roadway were protected from vehicular traffic. Employees did not wear high visibility apparel to protect them from the struck-by hazards from on-coming traffic. Among other methods, one feasible and acceptable method to correct this hazard would be to follow Chapter 6, Temporary Traffic Control, as delineated in the Manual on Uniform Traffic Control Devices, 2003 edition, Section 6E.02 High Visibility Clothing.
