Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to hazards while working at elevations:
On May 05, 2008, an employee of G & B Heating and Air Conditioning, Inc.
fell
approximately 9ft while working from the 12' top section of a Werner 24'
fiberglass
extension ladder. The employee was using the top section separately from
the bottom section.
The manufacturer of the extension ladder, Werner, had warning signs on the
top section of
the extension ladder stating that the top section was not designed for
separate use.
Among other methods, one feasible and acceptable method of abatement to
correct this
hazard is:
a)Follow and implement the manufacturer's labeled requirements, "Caution.
This
ladder section not designed for separate use."
b)Ensure that the ladder base is placed with secure footing on a firm,
level support surface - Section 9.3.4 of American National Standards
Institute (ANSI) A14.5-2007, American National Standard for Ladders
- Portable Reinforced Plastic Safety Requirements.
