General-duty citation text
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and struck-by hazards: An employee was exposed to fall and struck-by hazards while riding on the forks attached to a skid steer and holding a 55-gallon drum to prevent it from tipping as the skid steer was driven to the dumping area. Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to provide an attachment to the skid steer made to prevent the drum from tipping while being transported and prohibit riders on the skid steer or its attachments as per the Association of Equipment Manufacturers (AEM) Safety Manual for Operating and Maintenance Personnel.
