Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about September 4, 2008, employees were exposed to rollover hazards and potential crushing injuries in the event of a rollover while operating a Grasshopper 723K commerical lawn mower. The rollover protective structure (ROPS) had been removed from the mower. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: Re-install the rollover protective structure (ROPS) in accordance with the operator's manual. ***Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c)***
