Section 5(a)(1) of the Occupational Safety and Health Act of 1970:
The employer did not furnish employment and a place of employment which
were free from recognized
hazards that were causing or likely to cause death or serious physical
harm to employees in that they were
exposed to an amputation hazard :
a) On site, 210 S.Osceola Ave., Clearwater, FL 33756, east side of the
building - An employee was cutting
metal and was using a Delta radial arm saw ( Delta number
438-02-314-2032). The saw had a defective cutter
head return spring and the saw was not installed so that the front of the
table was slightly higher than the rear.
The saw did not return to the starting position and allowed the lower
blade guard to be raised by the fence
exposing the employee to an amputation hazard, on or about 5/18/07.
One means of feasible abatement, among others, is to follow the
manufacturer's requirements for installation
in the Instructional Manual which refers  to additional information
regarding operation and installation of the
saw under American National Standards Institute (ANSI) O1.1 and the Power
Tool
Institute.
