Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of falling while using a scissor lift. On or about May 2, 2007 and at times thereof, at the work-site located at 1901 Manhattan Blvd. in Harvey, LA Diversified Commercial Contractors, Inc. Site Instance - An employee was standing on the side section mid-rails while installing metal studs; thus being exposed to a fall of approximately 10 feet to the concrete floor below. A feasible means of abatement would be to comply with the American National Standards Institute, ANSI A92.6-1999 Standard for Self-Propelled Elevating Work Platforms, Section 8.10(9) entitled Operator Warnings And Instructions which states "Personnel shall maintain a firm footing on the platform floor while working thereon" and "Climbing by occupants on the mid-rail or top-rail of the aerial platform is prohibited".
