Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fire and explosion hazards: (a)Assembly - Employees used a Crouch Machinery horizontal belt sander to edge sand wooden pieces to prep them for laminate. The employer had the sander connected to a Jet enclosureless dust collector, model DC-1182, serial number 7910596. The dust collector, which contained a Class II explosive wood dust, got emptied only every few months, and the employer had the dust collector located about three feet from the sander and 12 feet away from a saw and an aisleway, on or about March 18, 2008. ABATEMENT NOTE: Among other methods, one feasible and acceptable abatement method to correct this hazard includes following the National Fire Protection Association (NFPA) 664, Standard for the Prevention of Explosions in the Wood Processing and Woodworking Facilities, 2007 Edition, including, but not limited to, removing the collected dust from the dust collector daily or more frequently if necessary to ensure efficient operation and locating the collector at least 20 feet (6.1 m) away from any means of egress or area routinely occupied by personnel as listed in Paragraph 8.2.2.5.1.4 of NFPA 664. VERIFICATION REQUIRED
