Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was injured when he was struck by an unsecured window, enclosed in a crate. (a) Location - 2nd floor, 77 Forth Avenue, Waltham, MA: On or about May 9, 2007, employees were exposed by struck by or crushing hazards from unsecured wood crates. Among other methods, feasible and acceptable means of abating this condition includes but not limited to: securing the crate in a manner that prevents them from falling during movement. 1. Work with the manufacturer of the Toyota floor jack to provide specific equipment or modification of existing equipment to safely transport similar window wood crates at the job site. 2. Provide appropriate rigging for the wood window crates during movement that would provide safe support for window wood crates to prevent crates from falling or tipping.
