Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that the
employees were exposed to fall hazards:
Waste recycling facility, 123 Varick Ave, Brooklyn, NY
On or about March 15, 2007
Employees who walk on top of railcars full of Construction and Demolition
debris approximately
15 feet 6 inches from ground level, to secure tarps on top of the cars.
These employees are not
provided with fall protection.
Among other means, one feasible and acceptable abatement method to correct
this hazards is:
Use platforms such as a scaffold erected around the railcar from which the
employees can
perform the screen securing operation. Another method would be the
installation
of a fall
protection system with a static line to which employees connect before
stepping off of a car
ladder they use to mount the railcar.
NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION
FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY
OF $1000.00 AS PER 29 CFR 1903.19.
