Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to a serious fall related accident in that an employee was
stood on the midrail of
a scissor lift's standard guardrail system, in order to reach an area
where he had to perform
work:
a) Building #1, south side of 2nd floor;
An employee stood on the midrail of a "Skyjack" scissor lift's standard
guardrail system in order
to reach an area where he needed to perform work. He was exposed to a fall
hazard of
approximately 17 feet to the concrete floor below.
Among other method's, one feasible and acceptable abatement method to
correct this hazard is
to comply with ANSI A 92.6-1999, Self-Propelled Elevating Work Platforms,
Section 7.10,
paragraph 9 which states: "Personnel footing. Personnel shall maintain a
firm footing on the
platform floor while working thereon. Climbing by occupants on the midrail
or toprail of the
aerial lift platform is prohibited. The use of planks, ladders or any
other devices on the platform
for achieving additional height or reach is prohibited".
