Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being thrown from a forklift truck: Outside in the Yard - The forklift truck seat belt was wedged behind the seat, was not available for use, and was not used. Employees were not protected from the hazard of being accidentally thrown from a forklift truck. Among the feasible controls include: 1)making the existing seatbelt straps readily available by moving the straps from under and behind the seat, and by 2)using the seatbelt.
