Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential crushing and/or struck-by hazards from falling racks and/or stored materials: (a) Storage cooler, for employees loading, unloading and working nearby the storage racks and having exposure to potential crushing and/or struck-by hazards where the racks were not adequately secured to the floor. Among other methods, one feasible and acceptable method of abatement would be to ensure that the upright posts are properly anchored.
