Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a)On March 12, 2007, two employees of Twin City Security, Inc. were
observed
performing traffic control and crossing guard duties at the intersection
of E. Oakton and
Maine West High school in Des Plaines, Illinois; without high visibility
apparel and hand
held signaling devices.  The employees were exposed to struck by and run
over hazards
from lack of being highly visible while performing their tasks within the
4 lane 34 mph
street.
Among other methods, one feasible and acceptable method to correct this
hazard is to
ensure that high visibility apparel is worn that meets ANSI/ISEA 107-2004
used in
accordance to Part VII, Traffic Control for School Areas, Manual on
Uniform Traffic
Control Devices (MUTCD) 2003 Edition, Federal Highway Administration, U.S.
Department of Transportation.
IN THE ALTERNATIVE
29 CFR 1910.132(a):  Protective equipment was not used when necessary
whenever
hazards capable of causing injury and impairment were encountered.  On
March 12,
2007, employees were not wearing high visibility apparel and using hand
held signaling
devices while working within on going motor vehicular traffic on E. Oakton
Street in
Des Plaines, Illinois:
On March 12, 2007, Twin City Security, Inc. did not ensure that its
employees exposed
to hazards caused by motor vehicular traffic were highly visibly by means
of wearing
high visibility apparel and using hand held signaling devices.   The
employees were
observed performing traffic control and crossing duties within the 35 mph
4 lane active
roadway; both of the employees were without the usage of hand held
signaling devices
and one not wearing high visibility apparel such as but not limited to a
fluorescent safety
vest.  The employees were exposed to the hazard of being struck and run
over by the
motor vehicles traveling east and west bound on E. Oakton Street in Des
Plaines, Illinois.
**In accordance with 29 CFR 1903.19(d), abatement certification is
required for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition,
documentation demonstrating that abatement is complete must be included
with your
certification.  This documentation may include but is not limited to,
evidence of the purchase
or repair of the equipment, photographic or video evidence of abatement,
or other written
records.**
