Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards from working/riding on an unapproved platform: Among other methods, one feasible and acceptable method to correct this hazard is: Use an approved platform designed by the manufacturer in accordance with All-terrain Forklift operations manual. a.On or about March 29, 2007, at the job site on the East side at the North end of the site , the JCB 550 All-Terrain forklift was not being used in accordance with the manufacturers operation manual to lift personnel, employee were exposed to a fall hazards.
