Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: a)On or about 03/26/07, at the Eastwood Village construction site, employee(s) of Hamilton Masonry Construction, Inc. worked from the GEHL rough terrain forklift truck personnel work platform which was not designed by nor approved by the manufacturer nor did the personnel work platform comply with ANSI/ASME B56.6-2002, Sec. 8.24, "Platform for Elevating Personal". b)On or about 03/26/07, at the Eastwood Village construction site,the Personnel Work platform was not securely attached to the forking mechanism by a chain or similar device. c)On or about 03/26/07, at the Eastwood Village construction site, the guard rail/gate/access opening of the Personnel Work Platform was not secured/restrained to withstand 200 lbs of force without deforming. The gate was secured by a wire. Among other methods, one feasible and acceptable method to correct this hazard is: Use an approved platform or a platform designed by the Manufacturer in accordance with the ANSI/ASME Standard B56.6-2002,"Safety Standard for Rough Terrain Forklift Trucks".
