North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck by and crushed by the backhoe and/or ROPS during rollover: a)barrow pit - where the employee was fatally injured when the CASE Model 680G Backhoe (S/N 9136031, with ROPS S/N 9225481) he was operating tipped, ejecting him from the cab and overturning on him. Abatement note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to have operators fasten the installed seat belt when operating equipment. References: Operator Protection for Wheel Type Agricultural and Industrial Tractors - SAE J333a, Paragraph 4.1 "In order to fulfil the intended purpose of this standard, tractors shall be equipped as follows:" 4.1.1 "A protective frame per SAE J334."; 4.1.2 "Seat belts conforming to SAE J4." Additionally, 30CFR.56 Safety and Health Standards - Surface Metal and Non-Metal Mines, Paragraph 56.14130(g) Roll-Over Protective Structures (ROPS) and seat belts; "Wearing seat belts. Seat belts shall be worn by the equipment operator except that when operating graders from a standing position, the operator shall wear safety lines and a harness in place of a seat belt." Or, in the alternative: 29 CFR 1910.132(a); Protective equipment was not provided, used, and maintained in a sanitary and reliable condition wherever it was necessary by reasons of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function or any part of the body through absorption, inhalation or physical contact: a)barrow pit - where the employee was fatally injured when the CASE Model 680G Backhoe (S/N 9136031, with ROPS S/N 9225481) he was operating tipped, ejecting him from the cab and overturning on him.turning
