North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: crushing injuries from being exposed to the moving bucket of the excavator. a)job site - employees were allowed to work underneath, and directly adjacent to the bucket of a Caterpillar Model 312B Excavator during digging operations. On or about August 2, 2007, this condition resulted in a fatality. Reference: 311B, 312B, and 312B L Excavators Machine safety publication from Safety.Cat.com.
