North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to thrown against, struck by and crushed by Roll Over Protection System (ROPS) hazard during tipover: a)new residential construction site - where the seat belt of the Piggyback Princeton Delivery System, #1335, three-wheeled forklift, was routed and fastened behind the seat of the forklift during operation. Abatement note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to have operators fasten the installed seat belt when operating equipment. References: Decal directly to left of operator's position "WARNING Fasten your seat belt." Decal directly under the steering wheel "WARNING SEAT BELT MUST BE FASTENED TO DISENGAGE BRAKE" Operator's Manual: "BEFORE STARTING be sure: Seat belt is fastened." ASME B56-6-1992, Paragraph 6.2.1: Before starting to operate the rough terrain forklift truck: (a) be in operating position and fasten seat belt, if so equipped. b)new residential construction site - where the operator of the Piggyback Princeton Delivery System, #1328, three-wheeled forklift, was not wearing the installed seat belt during operation.
