Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: (a)On June 22, 2007, at a location near 1801-1805 Gates Drive West, Platte City, Missouri, an employee was exposed to possible fall and/or amputations hazards from "riding the bucket" of a backhoe to get into and out of the trench. The fall hazard included falling over 8 feet to the bottom of the trench and the amputation hazard were posed by the scissoring action from the backhoe's articulated arm and bucket attachment. An acceptable means of abatement would be to positively require employees to maintain a safe distance from the backhoe or any of its moving parts anytime the devise is in operation, and to provide ladders, ramps or stairways so that the employees have a safe means for getting into and out of the trenches. Abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition,documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
