Chapter 15 of Title 41, Code of Laws, State of South Carolina, 1976, as
amended, as
follows:
A.  Employer knew or should have known that employee engaged in water
removal from
manhole was exposed to hazards associated with entry into confined space
such as, but not
limited to, potential hazardous atmosphere at the Market Commons site.  A
feasible and
useful method to correct this hazard, among other methods, is to (1)
develop and implement
a written confined space program including, but not limited to, safe work
procedures and
preplanned rescue procedures; (2) test, with a calibrated direct-reading
instrument, for
oxygen content, flammable gases and vapors, and for potential toxic air
contaminants prior to
employee entering the confined space; (3) ensure that no hazardous
atmosphere exists within
the confined space whenever any employee is inside the space; (4) provide
clean source
forced air ventilation prior to any employee entering the confined space
and until employee
has left the space; and (5) provide and utilize rescue equipment such as
tripod safety line,
body harness, stand by person, proper respirators and any other equipment
as necessary.
