SCRR 71-112A: Failed to furnish a place of employment which is free of
recognized hazards
which may cause death or serious physical harm to his employees and comply
with this
regulation and other occupational safety and health rules and regulations
promulgated under
Chapter 15 of Title 41, Code of Laws, State of South Carolina, 1976, as
amended, as
follows:
A.  Employer knew or should have known that employee checking for leak in
manhole was
exposed to the hazards associated with entry into confined space such as,
but not limited to,
potential hazardous atmosphere, at the Orchard Pointe job site.  A
feasible and useful method
to correct this hazard, among other methods, is to 1) develop and
implement a written
confined space program, including, but not limited to safe work procedures
and preplan
rescue procedures; 2) test, with a calibrated direct reading instrument,
for oxygen content,
flammable gases and vapors, and for potential toxic air contaminants prior
to employee
entering the confined space; 3) ensure that no hazardous atmosphere exists
within the
confined space whenever employee is inside; 4) provide clean source forced
air ventilation
prior to entering space and until employee is out; and 5) provide and
utilize rescue equipment
such as, tripod, safety line, body harness, respirator and stand by person.
