Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The
employer did not
furnish employment and a place of employment which were free from
recognized hazards that
were causing or likely to cause death or serious physical harm to
employees in that employees
were exposed to:
a)On April 18, 2007, at Old Orchard Mall (Former Saks Entrance) in Skokie,
IL
employees of HWZ Distribution Group, LLC dba NexGen Building Supply were
observed exposed to struck by hazards as they were delivering
drivet/exterior wall
materials to a subcontractor, from outside of the flatbed truck that was
blocking a lane
of traffic.  There were no flashing amber lights installed on the flatbed
delivery truck to
aid in veering traffic away from the workers, in accordance to the Manual
of Uniform
Traffic Control Devices (MUTCD), 2003 Edition.
b)On April 18, 2007, at Old Orchard Mall (Former Saks Entrance) in Skokie,
IL
employees of HWZ Distribution Group, LLC dba NexGen Building Supply were
observed exposed to struck by hazards as they were delivering
drivet/exterior wall
materials to a subcontractor, from outside of the flatbed truck that was
blocking a lane
of traffic.  There are no posted speed limits and motorists were traveling
via the ring
road at various speeds.  The employees were not wearing high visibility
apparel nor were
flaggers used to aid in veering traffic away from the employees as they
were delivering
the materials, in accordance to the MUTCD, 2003 Edition.
Among other methods feasible and acceptable method to correct this hazard
would be to follow
Chapter 6E Flagger Control and Chapter 6G Type of Temporary Traffic
Control Zone Activities
outlined in the Manual on Uniform Traffic Control Devices, 2003 Edition,
which includes, but
is not limited to, the following:  1)  High visibility apparel; 2)
Hand-signal devices such as
stop/slow paddles and or flags to control road users through temporary
traffic
control zones; 3)
Flagger station locations far enough in advance of work spaces for
approaching vehicles to have
sufficient stopping distance; 4) Flagger stations preceded by an advanced
warning sign or signs;
5) Rotating or strobe light control procedure for work vehicles; and 6)
Personnel training in safe
temporary traffic control practices and flagging procedures.
In accordance with 29 CFR 1903.19(c), abatement certification is required
for this violation
(using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).
