P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer
did not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard(s) of contact with high-pressure
water:
A) North Settling Basin - An employee operating a WaterJetting System was
not in control of
the switch to stop the jetting action of the hose.
Among other methods, one feasible and acceptable abatement method to
correct this hazard is
for the employer to ensure that the operator of the WaterJetting System is
in control of the
switch that engages/disengages the water jetting action.
