P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of being thrown from or crushed underneath a forklift in the event of a turn-over: A) Service area - The employees were utilizing a Baker forklift, which has an inoperative seat belt. One acceptatable and feasible means to correct this hazard would be for the employer to repair the seatbelt on the forklift and enforce seatbelt usage.
