P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and struck-by hazards: a)Front northwest corner of the building - An employee was exposed to fall and struck-by hazards while being elevated in the bucket of a Case Loader/Backhoe, model number 580 Super M. Among other methods, one feasible and acceptable abatement method to correct this hazard is to follow the Association of Equipment Manufactures (AEM) Safety Manual for Backhoe/Loader which states that before starting the engine, make sure that no one is underneath, around, or on the machine; before operation, clear all personnel from the machine and from the area; and never use the bucket for a work platform or personnel carrier.
