P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of being struck by and crushed by a top heavy electrical cabinet: a) Building #358 Main Entrance Portico - Employees were not protected from being struck by and crushed by a seventy inch tall, twenty-two inch wide rectangular Emergency Lighting System Battery Cabinet (1,919 pounds) while the unit was being lifted by a forklift during the removal of its shipping pallet. Among other methods, one feasible and acceptable means of abatement is to follow the Staco Energy Products Company User's Handbook (for the Firstline UPS Emergency Lighting System) instructions for "Unloading the Cabinet(s)" which describes how to remove the shipping pallet from the cabinet.
