P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard(s) of: An employee was exposed to being thrown out of the cab and getting crushed in the event of collision or tip over, as a result of not wearing seatbelts. a) Main entrance to construction site - On or about October 29, 2008, an employee who was observed operating a forklift was not wearing his seatbelt, as a result the operator was exposed to being thrown, ejected or crushed.
