P.L. 91-596 Section 5(a)(1) of the Occupational Safety and Health Act of
1970: The employer
did not furnish employment and a place of employment which were free from
recognized hazards
that were causing or likely to cause death or serious physical harm to
employees in that
employees were exposed to the hazard of falling off of an excavator bucket:
A) South side of job site - On or about February 12, 2009, an employee was
being lifted in the
air while standing on top of an inverted Bobcat excavator bucket.
One feasible and acceptable abatement methods to correct this hazard is:
Train excavator operators not to lift employees using the bucket of the
excavator.
